Terms of Service

These Terms of Service ("Terms") govern your access to and use of AskBarny (the "Service") at askbarny.com. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service

AskBarny turns a short description into designed, on-brand social media graphics and matching captions, sized for multiple platforms. Features and limits may change over time.

Your account

• You must be at least 16 years old and provide accurate information when you sign up.
• You are responsible for keeping your login credentials secure and for all activity under your account.
• Notify us promptly of any unauthorized use of your account.

Plans, credits, and billing

• Each AI generation uses one "shot." Free accounts include a limited number of lifetime shots. Paid plans (Pro, Max) include a monthly shot allowance that resets each billing period; unused shots do not roll over.
• You can also buy one-time credit packs that do not expire.
• Subscriptions renew automatically until cancelled. You can cancel at any time; access continues until the end of the paid period.
• Except where required by law, payments are non-refundable. We may change prices with reasonable notice.
• Editing or re-rendering something you already generated does not consume additional shots.

Acceptable use

You agree not to use the Service to:

• Create content that is illegal, infringing, deceptive, hateful, or harmful, or that violates others' rights.
• Impersonate others or use brand assets, logos, or trademarks you do not have the right to use.
• Abuse, overload, reverse-engineer, or attempt to disrupt or gain unauthorized access to the Service.

Your content

You retain ownership of the prompts and brand assets you provide. Subject to these Terms and applicable law, the graphics and captions you generate are yours to use, including commercially. You are solely responsible for your content and for ensuring you have the rights to any material (including logos and images) you upload or reference. You grant us the limited license needed to process your inputs and operate the Service.

Our intellectual property

The Service itself — including the software, templates, and design system — belongs to AskBarny and its licensors, and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.

Third-party services

The Service relies on third parties (for example, for authentication, payments, hosting, and AI generation). Your use of those features may also be subject to their terms.

Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind. AI-generated output may contain errors; you are responsible for reviewing content before you publish it.

Limitation of liability

To the maximum extent permitted by law, AskBarny will not be liable for indirect, incidental, or consequential damages, and our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim.

Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users.

Changes

We may update these Terms or the Service from time to time. Material changes will be posted here with an updated date; continued use means you accept the new Terms.
